Andrew McGann Appears in Court as Devil’s Den Double Homicide Suspect

WASHINGTON COUNTY, Ark Andrew McGann, the man accused of the Devil’s Den double homicide in July, appeared in court Thursday morning.

McGann appeared at the Washington County Courthouse for his status hearing. During the hearing, the state said additional discovery had been presented to the defense earlier this week. The defense agreed and said it will continue conducting its investigation.

McGann’s defense entered an order of continuance for the judge to sign, and his next scheduled court appearance is set for April 1 for a motions hearing.

ABC affiliate 40/29 News spoke with Washington County Prosecuting Attorney Brandon Carter, who said the state is focusing on pursuing the death penalty against McGann for his alleged involvement in the murders of Cristen and Clinton Brink.

“I expect because the state filed its notice of aggravating circumstances to seek the death penalty that he will be given notice of that in open court as well,” Carter said.

Carter explained that Arkansas law requires the state to prove at least one aggravating circumstance beyond a reasonable doubt for a jury to consider the death penalty if a defendant is found guilty of capital murder. Prosecutors are alleging three aggravating factors in McGann’s case.

“That he committed the capital murder of more than one victim,” Carter said. “That he committed the capital murder in a particularly cruel and depraved manner. And that he committed at least one of the capital murders with the purpose of evading arrest.”

McGann was previously in court in November, when more than a dozen motions were filed on his behalf, including one challenging the constitutionality of Arkansas’ capital murder statute.

McGann pleaded not guilty to two counts of capital murder in August 2025.
